There is no entitlement to the delivery of small quantities unless a separate agreement has been made.

  1. Payment Terms

Payment terms are agreed individually and are shown in the respective offer, order confirmation, or invoice.

  1. Delivery and Pickup

Delivery or pickup of goods takes place according to individual agreement.

Maria Handel GmbH is entitled to make partial deliveries if this is reasonable for the customer.

Delivery delays caused by force majeure, strikes, official measures, transport problems, supply shortages, import problems, or other circumstances beyond our control entitle us to postpone delivery accordingly or withdraw from the contract.

In case of pickup, the customer is obliged to collect the goods at the agreed time. If the goods are not collected on time, storage costs or other resulting costs may be charged.

  1. Transfer of Risk

For business customers, the risk of accidental loss or accidental deterioration of the goods passes to the customer as soon as the goods are handed over to the customer, carrier, freight forwarder, or any other person appointed to carry out the delivery.

In case of pickup, the risk passes to the customer or the customer’s representative upon handover of the goods.

  1. Retention of Title

The delivered goods remain the property of Maria Handel GmbH until full payment of all outstanding claims from the business relationship.

The customer is entitled to resell the goods in the ordinary course of business, provided that the customer properly fulfills their payment obligations toward us.

In the event of late payment, we are entitled to demand the return of goods subject to retention of title.

  1. Inspection of Goods and Complaints

The customer is obliged to inspect the goods immediately upon receipt or pickup regarding quantity, quality, visible damage, packaging damage, and completeness.

Visible defects, transport damage, or quantity differences must be reported in writing immediately, but no later than 24 hours after receipt of the goods.

For food products, fresh goods, or perishable goods, immediate inspection is especially important.

Later complaints can only be considered if the defect was not recognizable during proper inspection.

The customer must store complained goods properly and may not dispose of, return, or resell them without our consent.

  1. Food Products, Storage, and Shelf Life

For food products, the customer is obliged to observe all legal regulations, hygiene rules, storage instructions, temperature requirements, and best-before dates.

After handover of the goods, the customer is responsible for proper storage, handling, and resale of the products.

We are not liable for damage, quality loss, or spoilage caused by improper storage, incorrect temperature, damaged packaging after handover, or improper handling.

Best-before dates and batch numbers must be checked and observed by the customer.

  1. Returns and Exchanges

Returns or exchanges of defect-free goods are generally excluded unless expressly agreed otherwise.

This applies in particular to food products, perishable goods, special orders, promotional goods, opened packaging, or products specially procured for the customer.

Returns are only possible with the prior written consent of Maria Handel GmbH.

  1. Right of Withdrawal

Our offer is primarily directed at business customers and entrepreneurs.

Business customers generally do not have a statutory right of withdrawal like consumers.

As no direct online purchase takes place through this website, no automatic distance contract is concluded through the website.

If, in individual cases, a contract is concluded with a consumer, the statutory consumer protection and withdrawal rights apply where legally required.

We are not liable for damage caused by improper storage, improper resale, incorrect use of the goods, or failure by the customer to comply with legal regulations.
